Terms and Conditions

1. Introduction

Welcome to CyprusRide ("Platform", "Service"), a carpooling platform operated by KAHA ELECTRO MOBILITY LTD, a company registered in the Republic of Cyprus under the Companies Law, Cap. 113, with registration number HE 462511, incorporated on 8 July 2024, with registered office in Nicosia, Cyprus.

By accessing or using CyprusRide, you agree to be bound by these Terms and Conditions. If you do not agree with any part of these terms, you must not use the Platform.

2. Definitions

• "Platform" refers to the CyprusRide website and all related services.
• "User" refers to any individual who registers or uses the Platform, whether as a Driver or Passenger.
• "Driver" refers to a User who offers a ride on the Platform.
• "Passenger" refers to a User who books a ride offered by a Driver.
• "Ride" refers to a carpooling trip offered by a Driver.
• "Service Fee" refers to the commission charged by the Platform for facilitating the ride.

3. Eligibility

To use CyprusRide, you must:

• Be at least 18 years of age.
• Hold a valid driving licence issued in the Republic of Cyprus or another EU/EEA member state (if offering rides as a Driver).
• Have a registered and insured vehicle in good condition (for Drivers).
• Provide accurate and truthful personal information during registration.

4. Account Registration

Users must create an account to use the Platform. You are responsible for maintaining the confidentiality of your account credentials. You agree to notify us immediately of any unauthorized use of your account. KAHA ELECTRO MOBILITY LTD is not liable for any loss arising from unauthorized account access.

5. The Service

CyprusRide is a technology platform that connects Drivers and Passengers for shared rides within Cyprus. The Platform acts solely as an intermediary and is not a transport provider. KAHA ELECTRO MOBILITY LTD does not own, operate, or manage any vehicles and does not employ any Drivers.

The contractual relationship for the ride exists exclusively between the Driver and the Passenger. The Platform facilitates this connection but is not a party to the transport agreement.

6. Pricing and Fees

Drivers set the price per seat for each ride. The Platform charges a 15% service fee (commission) on each completed booking. This fee is deducted from the ride fare before the Driver receives their payout.

Payment processing is handled through Stripe. Standard Stripe processing fees (approximately 2.9% + €0.30 per transaction) apply and are deducted from the total amount. The Platform is not responsible for any fees imposed by your bank or payment provider.

7. Bookings and Cancellations

Passengers may request to book available seats on a ride. Drivers may accept or reject booking requests at their discretion. Once a booking is confirmed, both parties are expected to honour the arrangement.

Either party may cancel a confirmed booking. Repeated cancellations may result in account restrictions or suspension at the discretion of KAHA ELECTRO MOBILITY LTD.

8. Driver Obligations

• Hold a valid driving licence and vehicle insurance as required by Cyprus law.
• Ensure the vehicle is roadworthy and meets all legal requirements.
• Drive safely and in compliance with all applicable traffic laws of the Republic of Cyprus.
• Arrive at the agreed pickup location and time.
• Not charge Passengers any amount beyond the listed price on the Platform.
• Not use the Platform for commercial transport purposes — rides must be genuine cost-sharing arrangements.

9. Passenger Obligations

• Be at the agreed pickup location on time.
• Behave respectfully towards the Driver and other passengers.
• Wear a seatbelt at all times during the ride.
• Not bring any illegal, dangerous, or excessively bulky items.
• Complete payment through the Platform as required.

10. Verification

The Platform may request identity and driving licence verification from Drivers. Verified Drivers are indicated on the Platform. Verification does not constitute a guarantee of safety or reliability by KAHA ELECTRO MOBILITY LTD.

11. Limitation of Liability

To the fullest extent permitted by the laws of the Republic of Cyprus, KAHA ELECTRO MOBILITY LTD shall not be liable for:

• Any loss, damage, or injury arising from rides arranged through the Platform.
• The conduct, actions, or omissions of any User.
• Any delays, cancellations, or changes to rides.
• Loss of personal belongings during a ride.
• Any indirect, incidental, or consequential damages.

Users acknowledge that carpooling involves inherent risks and agree to use the Platform at their own risk.

12. Insurance

Drivers are solely responsible for ensuring adequate motor vehicle insurance coverage as required by Cyprus law (Motor Vehicles (Third Party Insurance) Law, Cap. 226). The Platform does not provide any insurance coverage for rides.

13. Intellectual Property

All content on the Platform, including but not limited to text, graphics, logos, and software, is the property of KAHA ELECTRO MOBILITY LTD and is protected by applicable intellectual property laws. Users may not reproduce, distribute, or create derivative works without prior written consent.

14. Account Suspension and Termination

KAHA ELECTRO MOBILITY LTD reserves the right to suspend or terminate any User account at its sole discretion, including but not limited to cases of:

• Breach of these Terms and Conditions.
• Fraudulent or misleading behaviour.
• Repeated cancellations or no-shows.
• Abusive behaviour towards other Users.
• Providing false or inaccurate information.

15. Governing Law and Jurisdiction

These Terms and Conditions shall be governed by and construed in accordance with the laws of the Republic of Cyprus. Any disputes arising from or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of Nicosia, Cyprus.

16. Amendments

KAHA ELECTRO MOBILITY LTD reserves the right to amend these Terms and Conditions at any time. Users will be notified of material changes via email or a notice on the Platform. Continued use of the Platform after such changes constitutes acceptance of the revised terms.
